La dezbatere sunt invita\u021bi s\u0103 participe to\u021bi ie\u015fenii care locuiesc la bloc, al\u0103turi de speciali\u015fti din cadrul Prim\u0103riei, reprezentan\u0163i ai furnizorilor de utilit\u0103\u0163i, dar \u015fi pe parlamentar locali. \u201c\u00cen cadrul activit\u0103\u0163ii de administrare imobile pe care o desf\u0103\u015fur\u0103m am constatat c\u0103 problematica asocia\u0163iilor de proprietari este vast\u0103, iar prevederile legislative referitoare la organizarea \u015fi func\u0163ionarea acestora, fie c\u0103 nu le reglementeaz\u0103 \u00een totalitate, fie c\u0103 defavorizeaz\u0103 locatarii fa\u0163\u0103 de furnizorii de utilit\u0103\u0163i\u201d, a precizat Tudor Tudose, directorul SC Termo-Service SA. Potrivit acestuia, reprezentan\u0163ii societ\u0103\u021bii ie\u0219ene au \u00eentocmit o list\u0103 \u00een 11 puncte cu propriile propuneri de modific\u0103ri legislative, printre acestea num\u0103r\u00e2ndu-se armonizarea termenelor scadente \u0219i cesiunea\u00a0 crean\u021belor. Dup\u0103 cum precieaz\u0103 speciali\u0219tii Termo-Service, sistarea utilit\u0103\u021bilor este o m\u0103sur\u0103 extrem\u0103, luat\u0103 de furnizori, care are \u00een vedere numai recuperarea direct\u0103 \u0219i imediat\u0103 a crean\u0163elor acestora, f\u0103c\u00e2nd abstrac\u0163ie de faptul c\u0103 o asocia\u0163ie are mai mul\u0163i proprietari, c\u0103 mare parte din ace\u015ftia sunt bun-platnici \u015fi c\u0103 prin aceasta se creaz\u0103 at\u00e2t probleme sociale c\u00e2t \u0219i o discriminare la nivel de cet\u0103\u021bean. \u201dAstfel, \u00een situa\u021bia \u00een care o asocia\u021bie nu achit\u0103 o factur\u0103 de utilit\u0103\u021bi \u00een termenul scadent de 15 zile, furnizorul este \u00een drept ca, dup\u0103 30 de zile de la data scaden\u021bei, s\u0103 solicite penalit\u0103\u021bi calculate \u00eencep\u00e2nd cu a 16 zi de \u00eent\u00e2rziere, dar \u0219i s\u0103 sisteze furnizarea serviciului. \u00cen schimb, asocia\u021bia are posibilitatea de a chema \u00een judecat\u0103 debitorii s\u0103i numai dup\u0103 expirarea perioadei de cel pu\u021bin 90 de zile de la data scaden\u021bei ultimei cote de contribu\u021bie la plata cheltuielilor de \u00eentre\u021binere, neachitate de debitor. Prin urmare, furnizorii de utilit\u0103\u021bi vor percepe penalit\u0103\u021bi dup\u0103 15 zile de la emiterea facturilor neachitate, iar dup\u0103 45 de zile pot \u00eentrerupe furnizarea utilit\u0103\u021bilor, perioad\u0103 \u00een care asocia\u021bia nu poate \u00eentreprinde nicio ac\u021biune de recuperare a crean\u021belor sale de la membrii debitori. Abia dup\u0103 trecerea altor 45 de zile, asocia\u021bia va putea demara ac\u021biunile \u00een instan\u021b\u0103 pentru obligarea debitorilor la plata restan\u021belor \u0219i a penalit\u0103\u021bilor aferente\u201d, sus\u021bin ace\u0219tia. Ac\u021biunea este una de durat\u0103, \u00een sensul \u00eendeplinirii tuturor actelor procedurale, administrarea de probe, c\u0103i de atac \u0219i execut\u0103ri silite. Din aceste considerente, Termo-Service propune ca situa\u021bia discriminatorie eviden\u021biat\u0103 anterior s\u0103 fie eliminat\u0103 prin armonizarea termenelor scadente at\u00e2t pentru furnizor c\u00e2t \u0219i pentru asocia\u021biile de locatari\/proprietari. \u00cen ceea ce prive\u0219te cea de-a doua propunere, care se refer\u0103 la cesiunea de crean\u021b\u0103, reprezentan\u021bii SC Termo-Service SA sus\u021bin c\u0103 asocia\u021biile de locatari\/proprietari care nu au personalitate juridic\u0103 nu pot sta \u00een instan\u021ba de judecat\u0103 ca reclamante \u00eempotriva debitorilor s\u0103i. \u201dChiar asocia\u021biile cu personalitate juridic\u0103 care au acces la justi\u021bie trebuie s\u0103 a\u0219tepte trecerea a 90 de zile de la data scaden\u021bei ultimei cote de contribu\u021bie la plata cheltuielilor de \u00eentre\u021binere p\u00e2n\u0103 s\u0103 poat\u0103 ac\u021biona \u00een instan\u021b\u0103 pe debitorii s\u0103i, dat\u0103 la care, deja de 45 de zile furnizorii au putut sista utilit\u0103\u021bile. De asemenea, exist\u0103 situa\u021bia \u00een care reprezentantul legal al asocia\u021biei de proprietari, din diferite motive obiective, nu poate sus\u021bine interesele acesteia \u00een fa\u021ba instan\u021bei sau nu poate \u00eendeplini anumite acte de procedur\u0103\u201d, afirm\u0103 reprezentan\u021bii Termo-Service. Din aceste motive, ace\u0219tia propun ca atunci c\u00e2nd o asocia\u0163ie de locatari\/proprietari nu poate recupera crean\u0163a sa de la membrii s\u0103i datornici s\u0103 o poat\u0103 cesiona unui furnizor de utilit\u0103\u0163i, acesta devenind astfel creditorul direct al debitorului cedat.
