Documentul are dou\u0103 anexe, din care una pentru persoanele fizice, iar cealalt\u0103 pentru persoanele juridice. Atestatul se elibereaz\u0103 pentru o perioad\u0103 de patru ani \u0219i poate fi suspendat sau retras, ca urmare a unei hot\u0103r\u00e2ri definitive, \u00een cazul \u00een care instan\u0163ele judec\u0103tore\u015fti competente au stabilit existen\u0163a unui prejudiciu cauzat de administrator, iar \u00een cazul persoanelor fizice inclusiv de c\u0103tre autoritatea emitent\u0103, la propunerea motivat\u0103 a Serviciului Asocia\u021bii Proprietari al Prim\u0103riei Municipiului Ia\u0219i. Men\u0163inerea \u00een func\u0163ie a unui administrator neatestat sau angajarea de c\u0103tre comitetul executiv (pre\u015fedinte) al asocia\u0163iei de proprietari a unui administrator neatestat atrage dup\u0103 sine aplicarea de sanc\u0163iuni contraven\u0163ionale conform Legii nr. 196 \/ 2018 privind \u00eenfiin\u021barea, organizarea \u0219i func\u021bionarea asocia\u021biilor de proprietari \u0219i administrarea condominiilor. Desf\u0103\u015furarea de c\u0103tre persoanele fizice sau juridice a activit\u0103\u0163ii de administrare a condominiilor f\u0103r\u0103 \u00eendeplinirea condi\u0163iilor prev\u0103zute de legea men\u021bionat\u0103 se sanc\u0163ioneaz\u0103 cu amend\u0103 cuprins\u0103 \u00eentre 5.000 lei \u0219i 10.000 lei. Pentru ob\u0163inerea atestatului de administrator de condominii, candidatul trebuie s\u0103 \u00eendeplineasc\u0103 urm\u0103toarele condi\u0163ii:<\/p>\n<ol style=\"text-align: justify;\">\n<li>s\u0103 aib\u0103 domiciliul \/ re\u0219edin\u021ba \u00een Municipiul Ia\u015fi;<\/li>\n<li>s\u0103 aib\u0103 capacitate deplin\u0103 de exerci\u021biu (minim 18 ani);<\/li>\n<li>s\u0103 ateste, prin cazierul judiciar, c\u0103 nu a suferit nicio condamnare, prin hot\u0103r\u00e2re judec\u0103toreasc\u0103 r\u0103mas\u0103 definitiv\u0103, pentru o infrac\u021biune de natur\u0103 economico-financiar\u0103;<\/li>\n<li>s\u0103 nu \u00eenregistreze debite la bugetul local;<\/li>\n<li>este apt din punct de vedere medical pentru exercitarea func\u0163iei de administrator condominii, fapt confirmat \u00een scris de medicul de familie;<\/li>\n<li>a absolvit un curs de formare profesional\u0103 continu\u0103 \u00een domeniul de activitate administrator condominii, organizat \u00een condi\u0163iile legii.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Pentru a fi autorizate \u00een vederea desf\u0103\u0219ur\u0103rii activit\u0103\u021bii de administrare a condominiilor pe raza Municipiului Ia\u0219i, persoanele juridice specializate trebuie s\u0103 \u00eendeplineasc\u0103 urm\u0103toarele condi\u0163ii:<\/p>\n<ol style=\"text-align: justify;\">\n<li>s\u0103 fie \u00eenfiin\u021bate \u015fi \u00eenregistrate potrivit legilor rom\u00e2ne \u015fi reprezentate de organele de conducere ale acestora;<\/li>\n<li>sa aib\u0103 punct de lucru \u00een Municipiul Iasi;<\/li>\n<li>s\u0103 nu fi intrat \u00een procedura insolven\u021bei, conform legisla\u0163iei \u00een vigoare specifice;<\/li>\n<li>s\u0103 nu \u00eenregistreze datorii restante la plata contribu\u0163iilor datorate bugetului de stat \u015fi bugetului local;<\/li>\n<li>s\u0103 aib\u0103 ca obiect de activitate administrarea condominiilor (conform Legii 196\/2018 privind \u00eenfiin\u021barea, organizarea \u0219i func\u021bionarea asocia\u021biilor de proprietari \u0219i administrarea condominiilor);<\/li>\n<li>s\u0103 fac\u0103 dovada raporturilor juridice (prin contract individual de munc\u0103) cu persoane fizice atestate \u00een condi\u021biile Regulamentului privind procedura de atestare a administratorilor de condominii &#8211; persoane fizice;<\/li>\n<li>s\u0103 dovedeasc\u0103 c\u0103 au bonitate, respectiv rentabilitate, lichiditate \u015fi solvabilitate, dup\u0103 caz;<\/li>\n<li>s\u0103 fac\u0103 dovada aplic\u0103rii \u015fi respect\u0103rii Legii 333\/2003 privind paza obiectivelor, bunurilor, valorilor \u015fi protec\u021bia persoanelor, \u00een sensul protej\u0103rii punctelor de \u00eencasare stabilite prin contract \u015fi a transportului de valori;<\/li>\n<li>s\u0103 fac\u0103 dovada unui num\u0103r de minim un angajat \u00eencadrat cu norm\u0103 \u00eentreag\u0103 la 1.000 de apartamente administrate, care s\u0103 de\u021bin\u0103 atestat de administrator condominii aflat \u00een termen de valabilitate;<\/li>\n<li>s\u0103 aib\u0103 angajat\u0103 minim o persoan\u0103 fizic\u0103 cu minim patru ore\/zi pentru func\u0163ia de casier la fiecare punct de \u00eencasare, \u00een condi\u021biile prev\u0103zute de Legea 22\/1969 privind angajarea gestionarilor, constituirea de garan\u021bii \u0219i r\u0103spunderea \u00een leg\u0103tur\u0103 cu gestionarea bunurilor agen\u021bilor economici, autorit\u0103\u021bilor sau institu\u021biilor publice \u015fi Decretul 209 \/ 1976.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Regulamentul va intra \u00een vigoare dup\u0103 aprobarea de c\u0103tre Consiliul Local, un proiect \u00een acest sens figur\u00e2nd pe ordinea de zi a \u0219edin\u021bei de miercuri, 29 decembrie.<\/p>\n<p style=\"text-align: justify;\">\n","protected":false},"excerpt":{"rendered":"<p>Municipalitatea inten\u021bioneaz\u0103 s\u0103 adopte un regulament privind procedura de atestare a administratorilor de condominii.
